By accessing or using BookScout (the “Service”), operated by Level Up Basket Corp. (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

BookScout is a web application that allows users to scan bookshelves, identify books, receive AI-powered recommendations, and manage a personal library. The Service is provided as a progressive web application accessible via supported browsers.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.

5. Subscriptions & Payments

Certain features require a paid subscription. Subscriptions are billed on a recurring basis through Stripe. You may cancel at any time; access continues until the end of the current billing period. Refunds are provided at our sole discretion. Prices may change with 30 days’ notice.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Upload malicious code or content that infringes on the rights of others.
• Use automated means to access the Service without our permission.

7. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, and software — are owned by or licensed to the Company and are protected by copyright, trademark, and other intellectual property laws. Book metadata and cover images are provided by third-party sources and remain the property of their respective owners.

8. User Content

You retain ownership of any content you submit (e.g., photos of bookshelves). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store it solely for the purpose of providing the Service. We do not sell your content to third parties.

9. AI-Generated Content

The Service uses artificial intelligence to provide book recommendations, summaries, and other outputs. AI-generated content is provided “as is” for informational purposes only. We do not guarantee its accuracy, completeness, or suitability for any purpose.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New Castle County, Delaware.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance.
